Clifford - whose husband just filed for divorce, is suing Trump over a nondisclosure agreement so that she can "tell her story" (in the form of a book, we imagine), while she is also suing both Trump and Cohen for libel after Trump called her statements "fraud" over Twitter, while claiming that Clifford fabricated a story that she was threatened by a man after she went to journalists with the story of her affair.
It is a potential problem for Mr Trump because undisclosed payments to bury embarrassing stories about a political candidate can be treated as a violation of United States campaign finance laws.
But Trump does respond to Cohen's suggestion of opening the shell company with a question: "What do we got to pay for this?" Trump has denied not only the affair but knowledge that Pecker's company paid her off then spiked its promised story about it in a so-called "catch and kill" move.
At one point, Cohen says of David, "I'll have to pay him something". "If you wanted to hide something, you would not do it by corporation or cheque", he said.

But, he tweeted, "I never would have thought that the US President would become one of the ones getting played by old KGB hands". John McCain's rebuke of Trump, comments criticizing Congressional Republicans, or otherwise, there is a clear theme here.
If Trump made the alleged payments with his own funds, and made the payments strictly for personal, not campaign reasons, he could be legally in the clear.
